Can Nonowners Make Contributions to an Account?

Currently, anyone can make contributions to an account, including the beneficiary. The Illinois Department of Revenue has stated (in a nonbinding general information letter) that the Illinois state income tax deduction is available to any individuals who contribute to an account. However, the account owner maintains control over all contributions, including the right to change portfolios, change beneficiaries, and make withdrawals.

Under current law, the federal gift and generation-skipping transfer tax consequences of a contribution by anyone other than the account owner are unclear. Accordingly, if a person other than the account owner wishes to make a contribution, he or she should consult tax and/or legal advisors to discuss the consequences.
